Terms of Service

By accessing or using Nia ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use Nia.

We may update these Terms from time to time. We will notify you of material changes by email or via in-app notice at least 14 days before the changes take effect. Continued use after that date constitutes acceptance.

You must be at least 16 years old to use Nia. By using the Service, you represent that you meet this requirement. If you are using Nia on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at security@nia.ai if you suspect unauthorized access.

You may not share your account, create accounts by automated means, or create an account if you have been previously banned from the Service.

You agree not to use Nia to:

• Generate content that is illegal, harmful, abusive, or violates the rights of others.
• Attempt to circumvent safety measures, rate limits, or access controls.
• Reverse engineer, scrape, or systematically extract data from the Service.
• Use the Service to train competing AI models without explicit written permission.
• Impersonate any person or entity, or falsely state your affiliation.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

You retain ownership of content you submit to Nia ("User Content"). By using the Service, you grant Nia a limited, non-exclusive license to process your User Content solely to provide and improve the Service for you.

Unless you opt in to training (see Settings → Data Control), your conversations are not used to train shared models. You can export or delete your data at any time.

Nia is an AI assistant. Outputs may be inaccurate, incomplete, or not suitable for all purposes. Do not rely solely on Nia for medical, legal, financial, or safety-critical decisions. We provide the Service "as is" and make no warranties about the accuracy of AI-generated content.

The Nia name, logo, product design, and underlying technology are owned by Nia Technologies, Inc. and protected by intellectual property law. You may not use our trademarks without prior written consent.

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as stated in our refund policy. We may change pricing with 30 days' notice.

If your payment fails, we will attempt to retry and notify you. After a grace period your account may be downgraded to the free tier.

You may cancel your account at any time from Settings → Account. We may suspend or terminate your access for violation of these Terms, non-payment, or for any other reason with reasonable notice, except in cases of serious violation where immediate termination may apply.

Upon termination, your right to use the Service ends. Provisions that by their nature should survive (ownership, disclaimers, limitations of liability) will survive termination.

To the fullest extent permitted by law, Nia is provided "as is" without warranties of any kind. We will not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the greater of $100 or the amount you paid us in the past 12 months.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.
